1) SUBJECT
Contracts for the sale of products stipulated at a distance via a telematic network on the site www.chevalfirenze.com, are governed exclusively by these general contract conditions.
2) PARTS
The present general conditions of contract exclusively regulate the sales contracts stipulated by consumers, meaning as such the natural persons acting for purposes unrelated to the entrepreneurial or professional activity possibly carried out by Cheval Firenze. The purchase order made by those who are not resident or domiciled in one of the authorized states or by those who have not completed their eighteenth year of age is considered ineffective.
3) CONCLUSION OF THE CONTRACT AND ACCEPTANCE OF THE GENERAL CONTRACT CONDITIONS
Product sales contracts Cheval Firenze on the site www.chevalfirenze.com are considered concluded at the time they are received Cheval Firenze the purchase order made by the consumer.
Cheval Firenze will promptly send the receipt of the purchase order to the consumer.
The consumer, with the electronic transmission of his purchase order, declares to have read and accepted these general terms and conditions and undertakes to observe and respect them in his relations with Cheval Firenze.
4) CONSUMER OBLIGATIONS
The consumer is required, before submitting his purchase order, to read these general terms and conditions carefully. The forwarding of the purchase order implies their full knowledge and acceptance.
Finally, once the online purchase procedure has been completed, the consumer is required to print and keep the present general terms and conditions, already viewed and accepted.
5) PURCHASE MODE
The consumer buys the product, the characteristics of which are illustrated online in the relative descriptions, at the price indicated to which are added the shipping costs specified on the site.
Before submitting the purchase order, the unit cost of each selected product is summarized, the total cost in the case of the purchase of multiple products and the relative shipping costs.
Once the purchase order has been placed, the consumer will receive from Cheval Firenze an e-mail message confirming confirmation of receipt of the order and containing information on the main characteristics of the purchased good, a detailed indication of the price, delivery costs, applicable taxes and means of payment, and containing a reference to the general conditions of the contract and to the information about the existence of the right of withdrawal, to the conditions and methods of its exercise displayed on the site. Following the approval of the Law Decree 4 July 2006 n. 223, maneuver bis, art. 37, paragraphs 8 and 9, converted with Law 248 of 4 August 2006, which came into force on 12 August 2006, the obligation to create the list of customers and suppliers is restored; this entails the indispensable need to request customers to insert a tax code in the appropriate fields on the site.

6) PAYMENT
The consumer can make the payment due by choosing one of the following methods.
a) Payment by credit card / PayPal
Payment for purchases by credit card is made through the PayPal circuit and can be made exclusively with the following credit cards: VISA, MASTERCARD, AMERICAN EXPRESS, VISA ELECTRON, AURA, MAESTRO and only by the holder / holder of the credit card. PostePay cards are enabled for payment as they belong to the Visa circuit.
The verification of the correctness of the payment data communicated by the consumer is the exclusive responsibility of the credit card issuing institutions.

b) Payment by bank transfer

The costs of issuing the transfer for foreign customers are the responsibility of the same. In the event of a bank transfer with commission paid by Cheval Firenze, a supplementary payment will be requested to cover the expenses.
In the event that the payment is made by bank transfer, the purchased good will be sent to the address indicated by the consumer upon receipt of the bank account, therefore on average 5 days after the transfer has been made.
7) DELIVERY OF PRODUCTS
The purchased good, together with the relative receipt / invoice, is delivered to your home address. Deliveries will be made in Italy and abroad.
The good is delivered by courier to the address indicated by the consumer. Any specific needs will have to be envisaged a Cheval Firenze from the consumer.
The delivery of the goods is guaranteed within a minimum of 2/3 working days in the national territory and max 5/7 working days for Europe, 7/10 working days for the rest of the world, unless the consumer has chosen the payment method through bank transfer pursuant to art. 6, letter b) of this contract, in addition to the order processing time (2/5 days).
Payment can be made in advance by bank transfer or credit card according to the instructions contained in the art. 6, letter b) of this contract and Cheval Firenze is required to send the goods at the time it receives confirmation of the transaction.
In case of non-delivery due to the absence of the recipient at the address indicated by him in the order, the courier will leave a notice and try again a second time; if the recipient is still absent, the goods will be returned to the sender (Cheval Firenze).
In the event that the package is retained by customs for checks, delivery may take a longer time not attributable to Cheval Firenze.
Delays caused by major forces (for example, earthquakes, climatic events, strikes, etc.) cannot be attributed to Cheval Firenze.
Orders placed during the weekend or on a public holiday will be processed from the first following working day. We also ask our customers to note that the preparation and shipping process may take longer during the holidays.
By signing the delivery, the responsibility for the goods passes to the buyer.
The person who signs, in fact, confirms the delivery receipt of the package and is responsible for the package itself.
8) GUARANTEE OF CONFORMITY AND DEFECTIVE PRODUCTS
Products purchased on the site www.chevalfirenze.com they are subject to the regulation on the sale of consumer goods contained in articles 1519 bis – 1519 nonies of the civil code.
The products delivered comply with the features shown online in the relative descriptions.
Without prejudice to the applicability of the remaining provisions contained in articles 1519 ter and following of the Civil Code, the aforementioned right is recognized by the consumer as long as the good delivered has been used correctly, in accordance with its destination and as provided in the instructions for use attached to the product purchased by him. In particular, the aforementioned guarantee does not apply to the good that presents defects of conformity that the consumer knew at the time of the conclusion of the contract or could not ignore with the use of ordinary diligence.
9) RIGHT OF WITHDRAWAL
The consumer has the right to exercise the right of withdrawa In particular, the consumer has the right to withdraw from any contract concluded with Cheval Firenze, without penalty and without specifying the reason. The user can apply within 14 working days following the date of delivery of the product, in accordance with the provisions of articles 64 and following of Legislative Decree 206/2005 (hereinafter the Consumer Code).
The conditions (pursuant to Legislative Decree 206/2005) for the return of the purchased product are:
– within 14 days of receipt of the order;
– undamaged and unused product;
– return in the original packaging.
The transport costs for the return of the products are the responsibility of Cheval Firenze in the event of errors in shipment of the color or model, factory defects attributable to the company. I am charged to the consumer for any other reason not attributable to a demonstrable and obvious error of the company.
Once the return has been approved, you will receive the amount in the same way that you made the purchase.
Once the return has been approved (the items must be in perfect condition and with the internal labels intact), you will receive an email to confirm that the amount will be paid into your account within 3-14 days.
IMPORTANT:
Returns of items that do not comply with the above will not be accepted. There is a maximum of one return request per order (with which it is possible to request the operation for more than one product).
10) EXPRESS TERMINATION CLAUSE
In case of total or partial non-payment of the purchase price of the goods, Cheval Firenze reserves the right to declare, pursuant to and for the purposes of art. 1456 of the Civil Code, the present contract terminated by sending a written communication to the electronic address of the consumer.
11) APPLICABLE LAW AND JURISDICTION
This contract is regulated by the Italian law. Any dispute relating to the stipulation, interpretation, execution or termination of this contract will be referred to the exclusive jurisdiction of the judge of the place of residence or domicile of the consumer, if located in the territory of the State.
12) REFERRAL
For matters not expressly provided for in this contract, the provisions of current Italian law apply.
